Terms and Conditions
ALL ORDERS THAT ARE PLACED THROUGH POPINADS.INFO ARE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS. BY PLACING AN ORDER IT IS UNDERSTOOD THAT YOU HAVE READ, UNDERSTOOD AND AGREED WITH THESE TERMS.
These TERM and CONDITIONS are an agreement between you ("CUSTOMER, CLIENT") and POPINADS.INFO ("us"). They should be read and understood.
Client acknowledges that by placing an order with POPINADS.INFO that they have read, acknowledged and fully understood ALL paragraphs of these TERMS and CONDITIONS. Client also acknowledges that these TERMS and CONDITIONS may be updated at any time without notice to Client, and that Client is responsible for periodically reviewing these TERMS and CONDITIONS to maintain complicance while Client has an active campaign with POPINADS.INFO
START OF SERVICE
All orders are placed into the advertising rotation within 7 (seven) business days following their order time as reported by our payment processor. However, orders are usually filled within several hours of the order being placed.
All campaigns are considered active the moment the campaign is entered into our system.
WEBSITE ERRORS
All visitors will be delivered to the URL submitted with the CLIENT's order. In the event of an error with the submitted URL, the CLIENT will not hold POPINADS.INFO or it's Partner Sites responsible for the error. Any visitors delivered to CLIENT's URL reflecting the error will not be credited or entitled to a refund.
In the event that the CLIENT's site becomes unavailable for any reason (server down or unavailable, timed out, internal server errors, or other common or uncommon errors associated with the internet and its underlying infrastructure), the CLIENT will not hold POPINADS.INFO responsible for these errors. Visitors delivered to the CLIENT's site during this time will not be credited or entitle CLIENT to a refund.
In the event that any of the above errors occur including any errors not listed but clearly intended, CLIENT may submit in writing a request for the campaign to be placed on hold. Upon resolution of the problem the held campaign will continue. CLIENT will not be refunded for any visitors delivered prior to the hold being placed on the campaign.
DELIVERY AND STATISTICS
We use a state of the art tracking system to track your ad campaign. Each order is given a unique campaign id which is used to track visitors to your site by day and time. When we provide an ad view, POPINADS.INFO points the visitors to this campaign id.
CLIENT understands that if the visitor viewing the the ad closes it before it finishes loading (due to network bandwidth, high impact graphics, animation or lack of interest on the visitors part, etc.), IT WILL COUNT AS AN AD VIEW ON OUR SYSTEM, WE HAVE SHOWN THE VISITOR YOUR AD AND HAVE THEREFORE FULFILLED OUR OBLIGATION. POPINADS.INFO cannot control the acts of the individuals viewing your ad and will not be held responsible for these actions.
CLIENT understands that HIT COUNTERS on your site DO NOT ACCURATELY REPRESENT THE NUMBER OF IMPRESSIONS OF YOUR RICH-MEDIA AD. CLIENT also understands that POPINADS.INFO DOES NOT GUARANTEE SALES OR SIGNUPS AND WILL NOT ISSUE A REFUND IF NONE ARE ACHIEVED. Client understands that NO GUARANTEES ARE MADE OF YOUR ADVERTISEMENT'S CLICK-THROUGH RATE.
ASSIGNMENT AND TRANSFER
CLIENT may not sell, assign or transfer any of the rights or services accompanying the purchase. CLIENT may not under any circumstances have any type of pop up advertising on the web site being promoted by POPINADS.INFO. CLIENT may not change the content of the URL being advertised in any manner without prior written approval by POPINADS.INFO authorized staff. Any attempt either by accident or design undermining the intention of this T.C. or the general principals that it was written for will result in immediate campaign deletion with no refund or adjustments available.
Clients choosing to change their ad content after being approved by POPINADS.INFO must first submit a request. Any CLIENT not submitting a request may have their advertisement campaign stopped indefinitely, and without a refund.
REPORTING AUTHORITY
In the event that there is a discrepancy between the number of ad impressions delivered by POPINADS.INFO, and the number of ad impressions delivered to the CLIENT, on their behalf, POPINADS.INFO and CLIENT both agree to use the report prepared by our ("POPINADS.INFO") campaign manager to be the official report. CLIENT understands and acknowledges that the campaign report received by POPINADS.INFO to be true and accurate and agrees to hold POPINADS.INFO, it's parent company as well as all companies and individuals involved harmless for any unexpected results arising from any advertising campaign.
CLIENT will accept a reasonable amount of discrepancy (10-15%) in the reporting of ad impressions delivered.
CLIENT understands that campaign delivery times are estimates only. Due to the nature of the Web, traffic flow to our servers cannot be predicted with complete accuracy. In the event of low traffic availability, campaigns may be delivered in more time than estimated at the time of ordering. CLIENT agrees to allow up to 14 days beyond the campaign estimate for promised ad impressions to be delivered. In the event of underdelivery past this 14 day limit, CLIENT may request in writing a partial refund for the remaining undelivered ad impressions. POPINADS.INFO will issue a refund for the value of the undelivered portion of CLIENT's campaign at the rate at which CLIENT paid for such impressions.
SUPPORT
Support is available at virtually all times. All requests must be made in writing via e-mail to addresses listed on the POPINADS.INFO website, or to e-mail addresses from which CLIENT has been contacted previously by our staff. CLIENT understands technical support may not be available at the exact time in which CLIENT initiates contact.
Client agrees to these terms and conditions of service and understands that they are legally binding.
REFUNDS
CLIENT is financially responsible for every ad impression ordered. CLIENT may request the campaign be ended but is not entitled to a refund. No refunds are issued under any circumstance once an advertising campaign has begun.
POPINADS.INFO shall be permitted to identify CLIENT as a POPINADS.INFO Client and may use CLIENT's name in connection with POPINADS.INFO marketing materials. Subject to the prior approval of each party, POPINADS.INFO may elect to issue a joint press release announcing the CLIENT's marketing partnership with POPINADS.INFO, which approval shall not be unreasonably withheld.
POPINADS.INFO will not promote spam, scam, hate, porn, warez, hacking or any other site/offer that could be considered offensive to the most discriminate viewer. Any attempt to bypass our intended guidelines will result in account cancellation and no recourse for refund.
